Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Digital Dassie, operated by Matthew Bracke as a sole proprietorship (eenmanszaak) in Gent, Belgium.

1. Services

Digital Dassie provides AI-powered automation services for small businesses, including but not limited to:

  • Missed call detection and automated follow-up messaging (SMS, WhatsApp)
  • AI-powered customer communication
  • Content automation and blog management
  • Digital presence management

2. Account and Eligibility

By using our services, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business.

3. Payment Terms

  • Services are billed on a monthly subscription basis unless otherwise agreed
  • Billing starts on the date of signup and renews monthly on the same date
  • Payments are processed securely via Stripe
  • All prices are in EUR and exclusive of VAT where applicable
  • Invoices are sent electronically
  • No refunds are issued for partial months of service
  • In case of a failed payment, a 7-day grace period applies before service suspension

4. Service Availability

We strive to maintain high availability of our services but do not guarantee uninterrupted access. We are not liable for downtime caused by third-party providers, force majeure, or scheduled maintenance.

5. Your Obligations

  • Provide accurate business and contact information
  • Use the services in compliance with applicable laws
  • Not use the services for spam, fraud, or illegal purposes
  • Pay all fees on time

6. Intellectual Property

All content, software, and technology used to deliver our services remain the property of Digital Dassie. Your business data and content remain yours.

7. Limitation of Liability

To the maximum extent permitted by Belgian law:

  • Digital Dassie's total liability is limited to the fees paid by you in the 3 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for missed business opportunities resulting from third-party service failures (e.g., telecom providers, messaging platforms)

8. Termination

  • You may cancel your subscription at any time with effect at the end of the current billing period
  • We may terminate or suspend services for breach of these Terms with reasonable notice
  • Upon termination, we will provide your data in a portable format upon request

9. Privacy

Your use of our services is also governed by our Privacy Policy.

10. Modifications

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect.

11. Governing Law and Disputes

These Terms are governed by Belgian law. Any disputes will be submitted to the competent courts of Gent, Belgium.
